1. Оператор
Наявні матеріали називають оператором Павла Олеговича Конощенка. Контакт: admin@adam-eva.app. Юрформу, реєстраційний номер і адресу слід підтвердити в реквізитах; код їх не містить. Terms регулюють Web/Android. Privacy notice, acceptance contract і окрема Article 9 explicit consent не змішуються.
2. Право й акаунт
Вам має бути 18+, потрібна дієздатність і законне право користуватися dating service. Надавайте істотно точні/актуальні дані; акаунт особистий. Не створюйте fake/duplicate accounts для обходу. Захищайте доступ і повідомляйте compromise. Ви відповідаєте за authorized actions, але не за наслідки порушення нами mandatory duties.
3. Сервіс
Adam & Eva надає profiles, discovery, likes, matches, chat, virtual gifts, referrals і optional Premium. Basic mode доступний без card details; Premium змінює показані limits, а promotions можуть дати time-limited Premium. Не гарантуємо match, reply, compatibility, relationship чи marriage. Account/badge/moderation status — не endorsement; moderation не гарантує identity, intent, truth або offline safety.
4. Безпека
Обережно діліться contact, financial, intimate, location info. Зустрічайтеся публічно, майте власний транспорт/вихід і попередьте trusted person. Не надсилайте гроші/codes під тиском. Report scam, impersonation, coercion, threats, exploitation, harassment/minors. При imminent danger зверніться до emergency services; Adam & Eva не є ними.
5. Заборонено
Minor access; fake/impersonation/account sale/ban evasion; fraud, money solicitation, spam, unauthorized commerce та payment/referral/gift abuse; harassment, stalking, threats, blackmail, hate/violence, чужі private data; illegal content, CSAM, non-consensual intimate/exploitative/explicit prohibited content, malware; bots/scraping/mass collection, attacks, unlawful access/payment/rate/privacy/moderation bypass, unauthorized commercial use; knowingly false reports. Mandatory interoperability, good-faith complaints і statutory rights не забороняються.
6. Ваш контент
Ownership лишається у вас; ви гарантуєте права й lawful upload. Надається non-exclusive worldwide royalty-free licence на host/copy/resize/transmit/display/technical adaptation лише для operation, safety, moderation, improvement, law і chosen features; sublicense тільки providers для цих функцій. Вона припиняється при deletion, крім delivered messages, cache/backup та narrow safety/legal hold. Немає unrelated advertising use вашого likeness без separate permission.
7. Модерація й appeal
За reasonable suspicion/violation, illegality, risk, fraud/payment abuse чи law можемо review/remove, reduce visibility, restrict, suspend/terminate proportionately до severity/repetition/risk; urgent temporary action можлива. Де required/safe, notice містить affected item, grounds/facts, automation, duration/appeal. Ban-case/support дає reply/evidence; review по можливості незалежний. Good-faith appeals дозволені. Illegal-content notice має точно вказати content/location/reason. DSA duties/exemptions залежать від legal classification/size і тут не вигадуються.
8. Premium
Features, price/tax, cycle, offer і renewal показуються before purchase за platform/country. Renewal — лише disclosed/authorized через Stripe Web або Google Play Android. Cancel у purchase channel/settings припиняє future renewal; access зазвичай до paid period end, якщо law/checkout не інакше. Deleting app не cancels. Failed/reversed payment може pause. Future changes require notice і не alter paid period. Promo Premium time-limited/non-cash, no paid renewal without separate authorization.
9. Gifts/referrals
Virtual gifts — in-service digital items, не currency/cash/transfer outside feature. Server verifies purchase/delivery; illegal/harmful content чи chargeback може remove. Ban/deletion не дає automatic refund, mandatory rights лишаються. Rewards потребують genuine eligible registration; self-referral, fake/duplicate, automation, purchased traffic, collusion/manipulation можуть invalidate reward і спричинити proportionate restriction.
10. Consumer withdrawal/refund
Mandatory conformity, remedy, refund і guarantees не виключаються. EEA distance service може мати 14-day withdrawal. Для digital content право втрачається лише після supply begins з prior express request/consent і required acknowledgment; для service діють statutory performance rules. Checkout/provider має capture choice — цей текст сам не є waiver. Звертайтеся до purchase provider і admin@adam-eva.app. Blanket “all sales final” немає.
11. Availability/third parties/IP
Можемо maintain, secure, update, change/discontinue features; downtime можливий. Material adverse paid-service change отримує required notice/remedy. Google/Play/Firebase, Stripe, Azure, IPinfo, OpenStreetMap мають own terms, але не знімають duties Adam & Eva. Code, brand, UI, design, databases і proprietary ranking/security (крім user/third-party content) protected; особиста non-commercial licence закінчується з contract.
12. Liability
To maximum extent permitted by law, немає liability за unforeseeable indirect/consequential loss або loss solely from unauthorized user conduct, unsafe offline meeting contrary warnings, UGC, your credential disclosure чи uncontrolled third-party. Uninterrupted availability/user truth не guaranteed. Не виключаються fraud, intentional/gross fault де не можна, death/injury from negligence, mandatory privacy/consumer liability. Invalid nominal cap не створюється.
13. Порушення
Ви відповідаєте за reasonably foreseeable direct loss від intentional/negligent breach, illegal content чи rights infringement за applicable law. Unfair B2B indemnity на consumer не покладається. Проти fraud, attacks і deliberate abuse доступні lawful remedies.
14. Termination
Ви можете stop/delete account; subscription cancellation окрема. Ми діємо за section 7 із mandatory notice/reason/appeal. Payment/IP/dispute/safety/evidence/liability survives лише legally necessary. Deletion не вигадує й не стирає transaction/acceptance record, lawful retained for limited claims/compliance period.
15. Versions/evidence
Published Terms зберігають fixed version/dates/hash і old editions. Material change потребує re-acceptance, typo — ні. Server records authenticated user, exact version/hash, server UTC, platform/client/session/correlation, не client timestamp чи aggressive fingerprint.
16. Law/complaints
Applicable law/courts визначають mandatory conflict/jurisdiction rules і confirmed operator establishment. Код цього не доводить, тому exclusive forum не вигадується. EEA/UK consumer retains mandatory home-country protection/courts. App support, anonymous landing form або admin@adam-eva.app не обмежують authorities/court. Invalid clause обмежується лише necessary extent.
